10 Adoption of Resolution Approving the Update of the General Plan Housing Element

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PACIFICA APPROVING THE UPDATE OF THE CITY OF PACIFICA GENERAL PLAN 2007-2014 HOUSING ELEMENT

Initiated by: City of Pacifica

 

                                                        WHEREAS, State Law, Article 10.6 of the California Government Code requires the Update of the City of Pacifica General Plan 2007-2014 Housing Element; and

 

                                                        WHEREAS,  on July 3, 2012 the State of California reviewed the Update of the City of Pacifica General Plan 2007-2014 Housing Element and found it met the statutory requirements; and

 

                                                        WHEREAS, the Update of the City of Pacifica General Plan 2007-2014 Housing Element Update has been prepared to meet the requirements of State law and local housing objectives, and is consistent with the other elements of the current City of Pacifica General Plan; and

 

                                                        WHEREAS, the Update of the City of Pacifica General Plan 2007-2014 Housing Element Update is consistent with the General Plan.  No development is permitted under the Housing Element Update where it is not currently permitted in the General Plan, and all new development analyzed in the Housing Element Update is in areas already designated for residential or mixed use; and

 

                                                        WHEREAS, the City Council of the City of Pacifica did adopt a General Plan on July 28, 1980 by Resolution No. 46-80; and

                                                       

                                                        WHEREAS, on October 15, 2012 the Planning Commission of the City of Pacifica did adopt a resolution approving the Negative Declaration for the update of the City of Pacifica General Plan 2007-2014 Housing Element by Resolution No. 871; and

 

                                                        WHEREAS, on October 15, 2012 the Planning Commission of the City of Pacifica did adopt a resolution recommending that the City Council approve the update of the City of Pacifica General Plan 2007-2014 Housing Element by Resolution No. 872; and              

                                         

                                                        WHEREAS, notice of the public hearing was duly published as required by the Pacifica Zoning Code and State Law; and

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Pacifica does hereby approve the Update of the City of Pacifica General Plan 2007-2014 Housing Element.

Assoc. Planner Diaz presented the staff report. He added that Planning Commissioner Leon was present if they had any questions.

Mayor DeJarnatt opened the Public Hearing and, seeing no one, closed the Public Hearing.

Councilmember Jaquith stated that she saw a reference to the Redevelopment Agency in the report, and she assumed that the RDA was dissolved during the preparation of this item.

Assoc. Planner Diaz stated that he had spoken with the State Housing Community Development department earlier and they said to leave it in for now and during the next cycle, they would address it.

Councilmember Jaquith asked when the next cycle would be.

Assoc. Planner Diaz stated that it would be January 2014.

Mayor pro Tem Stone acknowledged that there were lots of requirements for state funding entities, and asked if it would be addressed in the General Plan.

Planning Director White stated that it appeared that the timing was good for that. He stated that typically housing elements have their own cycle, being the only element in the General Plan required to be updated on a regular schedule that was different from the General Plan and usually happens independently as in this case. He thought that, based on the time frame for the General Plan process, they may be at the same place at the same time. However, he couldn’t say at this time how it will be folded into the General Plan, but they were going to start working on the new numbers, etc.

Councilmember Digre stated that, having read the Planning Commission minutes on this item, she agreed with the frustration of the Commission. She asked if she was accurate that doing this was not set in stone and the housing can be looked at again when they do the General Plan.

Planning Director White stated that, because they were delayed from the 2007 adoption of the housing element, they would be looking at this in earnest very soon because of the new requirements, adding that the preliminary elements have already been released.

Councilmember Digre referred to mention of folding this into the General Plan, and asked if it meant that some of these items could come up at that time.

Planning Director White agreed, adding that every time they look at it, the discussion will occur again based on the circumstances at that time.

Councilmember Digre mentioned that the Open Space Committee had asked numerous times for the density transfer discussion and it wasn’t done, but they said it would happen at the time of the General Plan.

Planning Director White stated that there might be some obvious connections between programs and implementation measures in the housing element that might relate to other areas of the General Plan.

Councilmember Digre stated that she didn’t recall if it was clear regarding the tandem parking for the small lots and asked if they had decided to put it in.

Planning Director White stated that it was a side recommendation from the Planning Commission. He mentioned that there was already an implementation measure in the housing element that talks about updating their secondary dwelling unit ordinance, which is outdated at this time, to be consistent with state law. They felt it would be an opportune time to deal with that issue at that time.

Mayor pro Tem Stone moved that the City Council adopt the attached resolution entitled “A Resolution of the City Council of the City of Pacifica approving the update of the City of Pacifica General Plan 2007-2012 Housing Element;” seconded by Councilmember Jaquith.

Mayor DeJarnatt stated that he was not crazy about this but, since he was not going to be there and in the interest of harmony, he was going along with it, adding that it wasn’t the time to get into it.
